Limited 20 Year Warranty

Subject to the limitations below, Colorado Organic Mattress LLC, a Colorado limited liability company ("Colorado Organic Mattress"), warrants your mattress to be free from defects in materials and workmanship for a period of 20 years after the date of purchase with 1-10 years non-prorated and the next 11-20 years prorated as per schedule A. 

This Warranty does not cover normal body impressions of one and one half inch or less in the mattress core. It does not cover aberrations in the natural latex that fall under the category of natural variances, i.e., areas of discoloration in the new latex, yellowing of latex over time, horizontal tears or cracks less than three inches in length, lateral tears or cracks that penetrate less than the full thickness of the latex sheet as well as evidence of black and/or white debris that is deemed to be residue of the natural latex baking process. Furthermore, if the latex core has been exposed to direct sunlight, excessive heat, or moisture, such exposure will void this Warranty. Loose threads, pilling, normal body contouring, and stretching of fabrics are considered cosmetic flaws and are not covered. Washing, drying, and/or dry cleaning will void the warranty of the mattress cover.  Colorado Organic Mattress shall not be responsible for any damage caused to the mattress by spills, burns, accidents, firmness preference, or other causes beyond its control. The warranty shall not apply if the mattress, foundation, or mattress cover has been physically damaged, burned, cut, torn or is abnormally soiled or unsanitary.

If your mattress is defective, Colorado Organic Mattress will repair or replace the mattress as described below, at no charge other than transportation costs, with the decision to repair or replace being at the sole option of Colorado Organic Mattress. During the first ten (10) years of this Warranty, Colorado Organic Mattress will not charge you to repair or replace your mattress if it is deemed defective. During years 11 through 20 of this Warranty, Colorado Organic Mattress will, at its option, repair the mattress at a handling cost to you, or replace the mattress at a prorated charge to you plus transportation costs. If Colorado Organic Mattress replaces the mattress, the prorated replacement charge you will pay will depend on when the mattress is replaced:

If the mattress is replaced during the eleventh year of this Warranty, the prorated replacement charge you pay will be fifty (50) percent of the original purchase price.
If the mattress is replaced after the eleventh year but before this Warranty expires, the prorated charge you pay will increase by five (5) percent for each subsequent year of the prorated period (i.e., 55% of the original purchase price if replaced during year twelve, 60% of the original purchase price if replaced during year thirteen, etc.).

If Colorado Organic Mattress deems the mattress not defective, all transportation costs are your responsibility and are in addition to any prorated charges.

Colorado Organic Mattress’s obligation under this Warranty is limited to repair or replacement of the mattress as described above. Colorado Organic Mattress shall not have any responsibility for incidental or consequential damages, including any bodily injury or damage to property. COLORADO ORGANIC MATTRESS MAKES NO WARRANTY OF MERCHANTABILITY OR WARRANTY OF FITNESS FOR ANY PARTICULAR PURPOSE. THE EXPRESS WARRANTY SET FORTH ABOVE IS YOUR EXCLUSIVE REMEDY.

This Warranty extends only to the original purchaser of the mattress.
